I agree. A trademark is a form of intellectual property that provides you with the rights about how your business name may be used. Trademarks may be obtained for specific words, phrases, logos, symbols, designs, images or a combination of these elements.
You are most likely going to need an attorney that has knowledge of intellectual property issues.
For some basic info do a Google search using the term - wikipedia trademarks. Wikipedia has a lot of information on that page to get you started. Pay attention to - service marks.
I further suggest that you research - creative commons.
